With the circle it brings up more the notion of level. We understand more the concept of the icon

I like the one with the circle for several reasons: It gives a better indication of what it is, it looks like more of a precision tool, and allows you to have the different shadow levels on the bubble and background (which is a nice touch).
Also, I agree with Chee Fang. The bubble may be better near the top of the icon, because that's the most likely place it would need to be for the most likely orientation on the device—if someone is holding it up or almost flat, they'd have the device tilted towards them, meaning the bubble would be near the top.
Nice work though. It's looking great.

i agree with you that I should let the bubble on the topside.
I made it for an App as precision tools and, as you say, if we hold device flat, the bubble would be near the top.,lol
