Hi Michael, thanks for your input. I actually did something by coincidence and a few other people pointed that out. I had never heard of Johnny Cupcake when I designed the logo, but after looking, I think it's a fantastic brand. However it does not monopolies the cupcake industry or skulls n bones, which was my inspiration for the design.
The truth is, the logo is not for designers, it's for our client who bakes cakes locally. It's something conceived in our studio and we feel confident that we have delivered what our client wanted without any plagiarism on our part.
Thanks for the suggestion. We've actually seen food logos with knives and forks and being that this is a cake company, we have actually found similar logos that had rolling pins and wooden spoons etc.
Ofcourse the response from designers is important and I'm probably going to be bothered that the idea I had happens to look like another brand, it's never nice, but I'll have to weigh it up and decide whether to stick with it or go back to the drawing board.
One thing I don't understand is how 'Iced Cakes' had anything to do with bones.
I think that regarding the logos being alike, it really is important because it is the brand, and the company you are working for could be taken to court on the matter, but then again, so many companies have similar logos and no one says anything. Either way, the problem should be mentioned to your client.
In my opinion though, it's not that big a problem.
The skulls and bones is associated with the attitude of the brand the client has built so far. It's not some pretty cupcake boutique, the owner wants a bit of rebellian.
Johnny Cupcakes does seem like an amazing brand and I guess we will have no choice but to redesign, given the reaction people are having. We're a talented team, we know too well that their are many ways to skin a cat.
We aren't talking about some global empire however, the brand is for a small business who services local businesses and individuals. So it won't be a train smash what ever we do, but we do have integrity and if so many people feel that adding bones to a cupcake is too close, we have to consider it.
Been designing a cupcake logo ourselves so thanks for the inspiration. I can see both sides of the argument above. I'm just surprised no one stated that Jonny Cupcakes don't actually make cupcakes. They're a clothing brand, unless it's April 1st of course http://www.youtube.com/watch?v=KUnaI0unzDY&feature=player_embedded

Tough call bro, they are huge and massively popular. For the sake of design integrity maybe consider a knife and fork for the "bones".
Its just way too close, while most people wont know the connection most designers definitely will :/

You could put the cupcake on a torn flag maybe? That would work too.
